According to the East Bay Times on May 24, the suit filed in November 2021 against the Piedmont Unified School District by the Children’s Health Defense and Protection of the Education Rights of Kids, as well as parents identified as Jane Doe and Janet Doe, was unconditionally settled on April 27. Alameda County Superior Court judge Brad Seligman struck down the district’s vaccine mandate for good after issuing a temporary stay in early January, ruling ultimately that the district failed to show why its policy should not be struck down.
As for the settlement, “under the agreement, the district not only repealed the mandate but also agreed not to consider any similar mandates in the future,” said the East Bay Times report.
PUSD’s Board of Education approved one of the strongest vaccine mandates in the state in September 2021. After the lawsuit was filed, PUSD dropped its vaccine requirement for in-person learning at the Jan. 26 school board meeting. The vaccination rate among PUSD students was more than 98% at that time.
