On July 4, Piedmont Police were called to a juvenile party on Hazel Lane where officers discovered an assault weapon (a Ruger AR-556 with a loaded magazine next to it) and open containers of alcohol in a vehicle that resulted in two arrests. Police Commander Lisa Douglas shared the latest updates to the case:
One of the subjects, 24-year-old Francisco Estigoy of Alameda, was placed on parole hold by the California Department of Corrections and Rehabilitation (CDCR). Parole holds authorize the detentions of parolees who have violated their paroles.
On July 8, the District Attorney’s office filed two felony charges against the second subject, 19-year-old Casey Vivona of West Haven, Utah: transporting an assault weapon across state lines and possession of an assault weapon. Vivona had admitted to Piedmont officers that he had brought the rifle from Utah two days before the incident.
According to California Penal Code, individuals who are caught possessing any assault weapon can be imprisoned for up to a year. Individuals who are caught transporting any assault weapon across state lines can be imprisoned for up to four, six, or eight years.
Note: The original dispatch by the Piedmont Police Department had originally noted down that the subjects were in a silver Mazda. However, according to documents obtained from the District Attorney’s office, the subjects were actually in a silver Mitsubishi.
